These Terms of Service (“Terms”) govern access to and use of the Jomioz website (including jomioz.com and its subpages), the Jomioz web and mobile software, Client Hub, and related services (together, the “Service”). The Service is provided by David Lander, trading as “Jomioz”; Tax ID (NIF/NIE): Y8422959M; Address for notices: Calle San Isidro, 2 - La Orotava - Tenerife - Spain; Email: info@jomioz.com. By creating an account, inviting users, clicking to accept these Terms, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that organization, and “you” includes that organization. “Account Owner” registers and bills the workspace. “Employee Users” are authorized team members. “End Users” are the Account Owner’s customers. “Customer Data” includes contacts, properties, jobs, schedules, estimates, invoices, notes, photos, signatures, messages, and similar operational content.
Jomioz is field-service software: customers/properties, scheduling and jobs, estimates and invoices, Jomioz Payments (powered by Stripe), Client Hub (approvals, deposits, e-sign, reschedule), email and (where connected) SMS/WhatsApp, checklists/time tracking, roles, and AI assist on eligible plans. Availability of currencies, payment methods, and messaging channels depends on configuration, plan, and local provider support. Features depend on plan and configuration. The Service is not a substitute for your legal, tax, or safety judgment and has no guaranteed SLA unless agreed in writing. In particular, you are responsible for confirming that invoices and tax settings you use in the Service meet the rules that apply to your business and your End Users. See Section 6.
Provide accurate registration data, keep credentials secure, and be of legal age. Optional two-factor authentication is recommended. The Account Owner controls access and is responsible for Employee Users. Use the Service only lawfully. Do not abuse security, spam, access others’ data, or process data you are not authorized to process. The Service is not designed for HIPAA PHI or cardholder data outside Stripe unless we agree in writing.
You retain ownership of Customer Data. You grant Jomioz a worldwide, non-exclusive license to host, process, transmit, back up, display, and otherwise use Customer Data solely as needed to provide and secure the Service on your documented instructions, and to create aggregated or anonymized statistics that do not identify you or any natural person. We do not use Customer Data to train third-party foundation models. For End User data you control, we act as processor/service provider under our Privacy Policy and any DPA. You are responsible for consent and compliance when messaging End Users (e.g. EU ePrivacy/anti-spam; US TCPA/CAN-SPAM). Customer payment collection (deposits, invoices, and related pay links) runs through Jomioz Payments (powered by Stripe). Jomioz is not a bank or payment institution. Payment card data is processed by Stripe; we do not store full card numbers for reuse outside Stripe’s tools. Invoices, tax, and local compliance are yours alone. We do not provide tax, accounting, bookkeeping, or legal advice, and we do not warrant that any estimate, invoice, credit note, tax rate, tax label, numbering, e-invoicing format, reporting file, or fiscal output is correct, complete, or compliant in any jurisdiction. You must choose correct tax rates and invoice content, comply with invoicing and VAT/GST/sales-tax rules that apply to your business, verify documents you send, and handle filings, audits, penalties, and disputes arising from documents you create or approve. Default tax settings and helpers are convenience tools only — check them before you send. To the maximum extent allowed by law, Jomioz is not liable for claims, losses, or penalties from non-compliant or incorrect invoices or tax treatment, except where that liability cannot be limited. Subscription fees are billed via Stripe per your plan; generally non-refundable except as required by law.
AI drafting features may be inaccurate; you must review outputs. We do not use Customer Data or AI prompts to train third-party foundation models. Beta features may change or end. Integrations (Stripe for Jomioz Payments and billing, Resend, Twilio/Meta, Mapbox, OpenAI, PostHog, analytics/hosting) are subject to those providers’ terms. Card data is handled by Stripe. Jomioz owns the Service and brand. Feedback may be used without obligation to you. Protect confidential information with reasonable care. You indemnify Jomioz against claims from your use, Customer Data, End Users, messaging/marketing, your invoicing or tax/fiscal compliance in any jurisdiction (including claims that documents created or sent with the Service were incorrect or non-compliant), or breach of these Terms, except to the extent caused by our gross negligence or willful misconduct.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” except non-excludable warranties. To the maximum extent permitted by law, we are not liable for indirect or consequential damages or lost profits/data. Aggregate liability in any twelve months is limited to fees you paid us in that period (or €100 / subscription-currency equivalent if none). Mandatory consumer protections in the EU/EEA/UK remain unaffected.
Cancel per plan settings or support. We may suspend or terminate for breach, unlawful use, non-payment, or risk to the Service. Export Customer Data while you have access; we do not promise indefinite post-termination hosting. Surviving clauses (IP, liability, indemnity, accrued fees) continue.
We may update these Terms by posting a new version; material changes will be communicated where appropriate. Governed by Spanish law; Spanish courts have exclusive jurisdiction subject to mandatory consumer rights you cannot waive in your country of residence.
